1. Prices
All prices are quoted in Swiss francs and are exclusive of statutory VAT. The shipping costs and conditions can be found here.

Prices can be changed at any time without stating reasons. Obviously incorrect prices are not binding for the seller. In case of doubt, the catalogue prices apply.

2. Payment and conclusion of contract
Payment is made by credit card (Mastercard, Visa), Twint, invoice or Post E-Finance direct transfer.

The purchase contract is only concluded when the seller confirms dispatch of the goods by email
(order or dispatch confirmation) or at the latest by delivery of the goods.

3. Delivery times
Deliveries are made from our warehouse in Altstätten or, depending on the information in the shop, with the specified delivery time. This is non-binding and is calculated in working days from receipt of payment. You can find detailed information about our delivery times at Shipping and payment. We make every effort to meet the specified dates and endeavour to constantly build up our product inventory to avoid delivery delays.

4. Goods inspection
The goods travel at the recipient’s risk. Transport damage must be reported to the post office immediately so that claims can be made. Complaints regarding missing or damaged material must be made in writing (email) within 5 days. The date of the postmark is decisive. No complaints will be processed after this deadline.
Returns are always at the buyer’s expense and must be accompanied by a completed return form .

5. Right of return and cancellation
Exchange or return of goods delivered in accordance with the contract is possible within 30 days. The product and the packaging must not be damaged. Should a delivery delay occur and last longer than 30 days, you are entitled to withdraw from the purchase contract, otherwise the contract remains. Exceptions apply in the case of a fixed date agreement.

6. The following are excluded from return
Goods manufactured according to customer specifications or which, due to their nature, are not suitable for return. Also excluded are damaged goods, incomplete goods, goods showing signs of use, as well as goods without packaging or with damaged packaging. In this case, Hongler Kerzen AG may claim compensation in the event of a return and will return the product immediately.

7. Warranty
The warranty of the products refers to the respective manufacturer’s warranty. Depending on the manufacturer, this is between 6 and 36 months. 

8. Retention of title
(1) For consumers we reserve title to the goods until payment has been made in full. If you are an entrepreneur acting in the course of your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, we reserve title to the goods until all outstanding claims from the business relationship with the buyer have been settled. The respective security rights are transferable to third parties.

(2) You are only entitled to offset if your counterclaims are legally established, undisputed or recognised by us. You are also only entitled to a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

(3) If you are in default with any payment obligation towards us, all existing claims will become due immediately.

9. Limitation of liability
Claims for damages due to delivery delays, incorrect deliveries, defective goods and consequential damages arising from the use of the products are excluded against us, unless the action is due to gross negligence or wilful misconduct.

10. Jurisdiction
For contracts with merchants, legal entities under public law or special public funds, the exclusive place of jurisdiction for all legal disputes arising from the business relationship, including actions on bills of exchange and cheques, is the registered office of Hongler Kerzen AG.

11. Payment due to default damages

If you do not make payment by the respective due date, you will be in default without further reminder. We do not charge reminder fees for the first three reminders. 

All further costs and expenses of Hongler Kerzen AG in connection with the collection of outstanding amounts, in particular reminder charges, fees for handing over the claim to a collection agency and the collection costs incurred, are to be borne by you. In the event of default, Hongler Kerzen AG is entitled to hand over the claim to a third party for collection. When the claim is handed over for collection, Hongler Kerzen AG will charge you collection fees in accordance with the default damages table of the Association of Swiss Debt Collection Trustees, which can be viewed at www.inkassoverband.ch.
